O2 customers can access O2 music content from the O2 Music Service subject to payment of the applicable fee per item of content (the "Service"). Customers will be charged on a per track basis. Details of the price will be available with each item of content before you purchase it.
To access the Service you must be an O2 customer, have paid the applicable Pay Monthly Fee or Pay & Go Fee in accordance with the general O2 Terms and Conditions, have an appropriate GPRS data tariff, and be using an O2 Digital Music Player together with a device that has been accredited to receive the Service. 01. Provision of the Service
This Agreement begins on the date that you first use the Service and will continue until terminated in accordance with this Agreement.
1.1 We agree to provide you with the Service in accordance with these terms and conditions.
1.2 We reserve the right to cease provision of the Service at any time.
1.3 We agree to exercise the reasonable care and skill of a competent communications service provider. We cannot guarantee that the Service will never be faulty, but we will correct reported faults as soon as we reasonably can. If a fault occurs you should report the fault to us by email or by calling the number on the Website. We do not guarantee the quality or availability of the Service. The Service is provided without any warranties or guarantees (including any warranties implied by law) unless expressly stated otherwise.
1.4 The Service (either in whole or in part) is accessed via a digital music player in conjunction with your mobile phone or other accredited device. You are responsible for the provision of, and payment for, the digital music player as well as any mobile phone handset or other accredited device necessary for connection to and use of the Service as well as all call charges and other fees charged for the use of such equipment.
1.5 We grant you the right to use the digital music player and the software installed on the digital music player for the Service only.
1.6 We may vary the technical specification of the Service from time to time.
1.7 We do not accept any liability for the incompatibility of the Service with any mobile phone or other equipment used by you.
1.8 We reserve the right to monitor use of the Service in accordance with any applicable laws in order to (i) maintain the Service, and (ii) to protect the rights of owners of music content and other customers of the Service;
02. Price and Payment
All music content will be charged for per downloaded track. Details of the price will be available with each item of content before you purchase it.
03. Use of the Service
3.1 You shall use the Service and the music content for private and personal use only and not for re-sale or rental or for any commercial purposes or in a way that infringes the rights of others.
3.2 You will not copy nor permit the use by any other person of the music content you have purchased.
3.3 You shall comply with all instructions issued by O2 from time to time regarding use of the Service. In particular:
a. You assume full responsibility for all charges related to accessing the Service, such as online access providers, telephone service providers, or others;
b. You warrant that any mobile phone number or other data that you have provided us with while using this Service is correct and relates to a mobile phone or accredited device owned and used by you and shall indemnify us in the event of any claim made against us or loss suffered by us which is inconsistent with such warranty.
3.2 You shall only access the Service as permitted by us and shall not attempt at any time to (i) circumvent the digital rights management software loaded onto the digital music player or any system security or (ii) access any source software or compiled code save as permitted by law.
04. Variation of Agreement
We may vary these terms and conditions and any other part of this Agreement at any time, such variation being effective immediately upon posting on the Website or by us notifying you by email or Message of the changes. You may stop using the Service at that time. By continuing to use the Service following any such variation of the terms and conditions, you will be deemed to accept the variation.
05. Your data
We will not disclose information gathered from the Service to any other parties except other companies within our group. We may disclose information (including information that identifies you personally) to third parties who assist us to provide the Service.
The information you provide may be held and used by us for market analysis and production of internal reports, for marketing our products and services generally and (subject to any objection or preference you may indicate when submitting your details to us) for sending information to you about our products and services from time to time. O2 owns or has a license for all rights in the Service. O2 expressly reserves all rights not expressly granted by O2 within the Website.

Noch eine Frage zum DMP: Wie sieht das mit der Rückgabe aus (14tägiges Rückgaberecht). Aber o2 schreibt, daß mit "abgehender Kommunikation" das Rückgaberecht erlischt. Ist das schon der Fall, wenn ich in der Song-DB stöbere?

Weil das Thema zumindestens ansatzweise hier gerade angesprochen wird...wie schauts bei O2 eigentlich mit dem Rückgaberecht aus?
Fallbeispiel:
1 ) Bestelle mir z.B. das SX1 Music online.
2) Handy kommt 2-3 Tage später an
3) Kann das Handy doch jetzt eigentlich 10 Tage mit meiner alten SIM
testen ( Hauptsache neue SIM wird nicht aktiviert, oder?) und dann
wieder zurückschicken. Richtig?!?
Wär für mich persönlich ne klasse Sache.

Da steht nichts davon, dass man das Music Pack nach nur drei Monaten kündigen kann und der Preis für den DMP ist auch nicht so toll.
Hätte doch letzen Monat den DMP für 15 EUR und bis zum Ende der Telefon-Laufzeit nehmen sollen.

Wo liegt eigentlich das Problem, habt ihr gedacht das ihr ab dem 1. August den Player weiterhin für 14,95 bekommen und auch noch nach 3 Monaten den Music Pack kündigen könnt......
